A. Introduction

This Privacy Policy applies to ExclusiveMotorWorks.com and related digital services (collectively, the "Digital Services") operated by Exclusive MotorWorks, Inc. ("EXM," "we," "us"). It explains what information we collect, how we use and share it, and the choices and rights available to you under applicable privacy laws. This policy describes our practices only — not those of third parties.

B. Information We Collect

1. Information you provide. Contact details (name, billing and shipping address, email, phone); account information; order and purchase history; vehicle year, make, and model when you use our fitment tools or provide it at checkout; payment information (processed by our payment processors — we do not store full card numbers); communications with our support team; reviews, photos, and other content you submit; and marketing preferences.

2. Information collected automatically. Device, browser, and operating system details; IP address and general location; device identifiers; pages viewed, clickstream data, and referring URLs; email engagement metrics; and information gathered through cookies, pixels, and similar technologies.

3. Information from third parties. Our e-commerce platform (Shopify), payment processors, analytics and advertising partners, social media platforms, and data providers.

C. How We Use Information

To process and fulfill orders (including sharing order details with the fulfillment partner that manufactures or ships your item); provide customer support and resolve disputes; operate, secure, and improve the Digital Services; verify vehicle fitment; process payments and prevent fraud; send transactional messages (order confirmations, shipping notifications — you cannot opt out of these while you have an active order); send marketing communications where permitted; personalize content and advertising; and comply with legal obligations.

D. How We Share Information

We share personal information with: fulfillment and manufacturing partners who produce and ship the products you order (they receive your name, shipping address, and order details only as needed to fulfill your order); service providers including Shopify, payment processors, shipping carriers, email and analytics providers; advertising partners for interest-based advertising; government authorities when legally required; and successor entities in a merger, acquisition, or asset sale. We do not sell your personal information for money.

E. Your Choices

• Email marketing: use the unsubscribe link in any marketing email.
• Text messages: reply STOP.
• Cookies: adjust your browser settings, or use the opt-out tools of the Digital Advertising Alliance (optout.aboutads.info) and Network Advertising Initiative (optout.networkadvertising.org).
• Mobile: use your device's ad-tracking limitation settings.
• Global Privacy Control: we recognize and honor the GPC browser signal as a valid opt-out of sale/sharing request.
• Direct mail: write to the address in Section M.

F. Data Retention

We retain personal information as long as needed for the purposes described above, considering the length of our relationship with you, our legal obligations, the need to establish or defend legal claims, and fraud prevention. Automatically collected data is typically retained for up to 24 months unless longer retention is required. Order records are retained as required for tax and accounting purposes.

G. Security

We use administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is 100% secure; we cannot guarantee absolute security. If a breach occurs, we will notify affected users as required by applicable law.

H. International Visitors

The Digital Services are operated from the United States and directed to U.S. customers. Information is processed and stored in the U.S., which may not provide the same data protections as your home jurisdiction.

I. Children's Privacy

The Digital Services are not directed to children under 13 (or under 16 where a higher age applies). We do not knowingly collect personal information from children. Parents who believe a child has provided us information may contact us at Info@ExclusiveMotorWorks.com.

J. Third-Party Links

We are not responsible for the privacy practices of third-party websites, apps, or platforms linked from the Digital Services. Review their policies independently.

K. Dispute Resolution

Privacy-related disputes are governed by the dispute resolution provisions of our Terms of Service.

L. Changes to This Policy

We will post updates with a new effective date. Material changes will receive advance notice by email or a prominent notice on the Digital Services.

N. U.S. State Privacy Rights

Residents of California (CCPA/CPRA), Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Iowa, Indiana, Tennessee, Delaware, New Hampshire, New Jersey, Nebraska, Maryland, Minnesota, and Kentucky have the following rights, subject to applicable law: to know/access the personal information we hold; to delete it; to correct inaccuracies; to data portability; to opt out of sale, sharing, targeted advertising, and profiling; to limit use of sensitive personal information; and to non-discrimination for exercising any right.

To submit a request: email Info@ExclusiveMotorWorks.com with your name, email, state of residence, and the right you wish to exercise, or write to the address in Section M. We verify identity before acting on requests and respond within the timeframes required by applicable law (generally 45 days for CCPA/CPRA). Authorized agents may submit requests with proof of authorization.

California "Shine the Light" (Civil Code § 1798.83): California residents may request a list of third parties to whom we disclosed personal information for direct marketing. Submit a written request marked "Your California Privacy Rights" to the address in Section M.

Nevada: Nevada residents may opt out of the sale of personal data by emailing Info@ExclusiveMotorWorks.com with the subject "Nevada Do Not Sell Request." We do not currently sell personal data as defined under Nevada law.
